1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the website, subscription platform, and content offered by The Longevity Collective (“TLC,” “we,” “us,” or “our”), a DBA of Luther Wellness Group, LLC, hosted through Kajabi (the “Service”). By creating an account or subscribing to the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to create an account. The Service is designed for and marketed to adults age 50 and older, though we do not restrict access solely by age beyond the 18+ requirement.

2. The Service

TLC is a subscription wellness platform offering workout videos, meal plans, educational articles, community programming, and monthly webinars organized around four pillars: Health, Community, Purpose, and Longevity. Content is provided for general informational and educational purposes only.

3. Medical Disclaimer

TLC is not a medical provider, and nothing on the Service constitutes medical advice. The workouts, meal plans, and wellness content are general in nature and not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider before starting any exercise program, changing your diet, or making decisions related to a medical condition — particularly if you have a pre-existing health condition, are pregnant, or are recovering from injury or surgery.

You assume all risk of injury resulting from your use of workout content or implementation of dietary suggestions provided through the Service. By using the Service, you confirm that you are physically able to participate in the type of activities offered and that you are voluntarily participating with full knowledge of the risks involved.

4. Subscription, Billing, and Cancellation

  • The Service is offered on a recurring monthly subscription basis at the price displayed at checkout (currently $22/month, subject to change with notice).
  • Your subscription automatically renews each month unless canceled prior to the renewal date.
  • Payments are processed through Kajabi and its integrated payment processors. You authorize us to charge your payment method on file for each billing cycle.
  • You may cancel your subscription at any time through your account settings; cancellation will take effect at the end of your current billing period. We do not offer refunds for partial billing periods unless required by law.
  • We reserve the right to change subscription pricing with reasonable advance notice to active subscribers.

5. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You agree to provide accurate, current information when creating your account and to keep it updated.
  • You may not share your account access with individuals who have not subscribed to the Service.
  • Notify us immediately of any unauthorized use of your account.

6. Acceptable Use

You agree not to: - Use the Service for any unlawful purpose or in violation of these Terms - Copy, reproduce, distribute, or resell any content from the Service without our written permission - Post content in community areas (such as Legacy Spotlight, Wisdom Wednesday, or Still Climbing) that is harassing, defamatory, hateful, sexually explicit, or otherwise inappropriate - Attempt to access accounts or data that are not your own - Interfere with or disrupt the Service, including through automated scraping or hacking attempts - Impersonate any person or entity or misrepresent your affiliation. 

We reserve the right to remove content and suspend or terminate accounts that violate this section, at our discretion.

7. Intellectual Property

All content on the Service — including workout videos, meal plans, articles, webinars, graphics, logos, and the TLC name and branding — is owned by Luther Wellness Group, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use this content for your personal, non-commercial use. No other rights are granted.

8. Community Content

If you post comments, testimonials, or other content within community programming, you grant TLC a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with operating and promoting the Service. You are solely responsible for content you post and confirm you have the right to share it.

9. Third-Party Services and Partners

The Service may reference or link to third-party partners (such as Anodyne Therapy, healthcare provider referral partners, or faith community partners). We are not responsible for the products, services, or practices of these third parties, and any engagement with them is between you and that third party directly.

10. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY WELLNESS OUTCOME WILL RESULT FROM USE OF OUR CONTENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUTHER WELLNESS GROUP, LLC AND THE LONGEVITY COLLECTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY INJURY RESULTING FROM PARTICIPATION IN WORKOUT CONTENT OR RELIANCE ON MEAL PLAN OR WELLNESS INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Luther Wellness Group, LLC. The Longevity Collective, and their owners, employees, and partners from any claims, damages, losses, or expenses (including attorney’s fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to TLC, other members, or third parties. You may terminate your account at any time by canceling your subscription.

14. Changes to the Service or These Terms

We may modify or discontinue the Service, or any part of it, at any time. We may also update these Terms from time to time; the updated version will be posted with a revised “Last Updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Nebraska, and you consent to the jurisdiction of those courts.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
